Welcome to use the product provided by this developer (hereinafter referred to as "we" for the convenience of description) "Face AI" and the website (hereinafter referred to as this APP). This notice informs you that the two parties to this agreement are the developer of the All-in-One Emoji Maker and the user of the software services (hereinafter referred to as the "User").
Before you start using this APP, please be sure to carefully read and fully understand the Service Agreement. Among them, important contents such as the user account, password and security, as well as the legality of the content uploaded by the user will be presented in bold for your attention. If you are under 18 years old, please obtain the consent of your legal guardian before downloading this APP.
1.
Acceptance of the Service Agreement
1.1 The services provided by this APP will be strictly implemented in accordance with its published articles of association, service agreement and operation rules. Users must fully agree to all the service agreements to become an official user of this APP.
1.2 This APP agrees to provide relevant Internet-based services (hereinafter referred to as the "Network Services") in accordance with the provisions of the Service Agreement and the operation rules published from time to time. In order to obtain the Network Services, the user shall agree to all the terms of the Service Agreement.
1.3 When the user clicks the "Agree" button during the use process, it means that the user fully agrees to accept all the terms under the Service Agreement, and the Service Agreement is established.
Unless you fully accept all the contents of the Service Agreement, you have no right to download, install, register, log in, or use (hereinafter collectively referred to as "use") this APP, or use the services provided by this APP in any way. If you use the relevant services of this APP, it shall be deemed that you have fully understood the Service Agreement and undertake to be bound by the agreement as a party to the Service Agreement.
2.
Change and Modification of the Service Agreement
2.1 This APP has the right to change or modify the Service Agreement at any time. When the user uses the services of this APP, the user should accept the rules or instructions related to the services provided by this APP at any time, and these rules or instructions shall all constitute a part of this Service Agreement. If the user does not agree to the modification or change of the Service Agreement, the user can take the initiative to cancel the Network Services already obtained; if the user continues to enjoy the Network Services, it shall be deemed that the user has accepted the modification or change of the Service Agreement.
2.2 When the Service Agreement is modified or other matters are changed, this APP will notify the user in the form of an email, a page announcement or a regular letter.
3.
User's Account, Password and Security
3.1 Once the user registers successfully, the user will become a legal user of this APP and will be given a password and an account. The user is obliged to ensure the security of the password and the account. The user shall bear full responsibility for all activities carried out using the password and the account; this APP shall not bear any responsibility for any losses or damages arising therefrom.
3.2 If the user's password and account are used without authorization or any other security problem occurs, the user can immediately notify this APP.
4.
Refusal to Provide Guarantee and Disclaimer
4.1 The user agrees to assume all risks associated with the use of the Network Services of this APP and shall bear all risks arising from the use of the Network Services of this APP. This APP makes no guarantee of any kind to the user and shall not bear any responsibility.
4.2 This APP does not guarantee that the Network Services will definitely meet the user's requirements, nor does it guarantee that the Network Services will not be interrupted. It makes no guarantee regarding the continuity, timeliness, security or accuracy of the services. For the interruption of the Network Services or other defects caused by force majeure, reasons that this APP cannot avoid or control, or other reasons, this APP shall not bear any responsibility, but will make every effort to reduce the losses and impacts caused to the user. The services provided by this product may include advertisements, and the user agrees to display the advertisements provided by this company and third-party suppliers and partners during the use process. Except as explicitly provided by laws and regulations, the user shall be responsible for the transactions carried out based on the advertising information. This company shall not bear any responsibility for the losses or damages suffered by the user due to the transactions carried out based on the advertising information or the content provided by the aforementioned advertisers.
4.3 This product only provides storage space for the content published and collected by the user. This product does not provide any form of guarantee for the content published and collected by the user: it does not guarantee that the content will meet your requirements, nor does it guarantee that the services of this product will not be interrupted (this product shall not bear any legal responsibility if the user cannot use this product normally due to any force majeure such as network conditions, communication lines, the requirements of third-party websites or administrative departments, or reasons not attributable to our company).
4.4 The content published and collected by the user on this product (including but not limited to the content in the existing products and functions of this product) only indicates the user's personal stance and views, and does not represent the stance and views of this product. As the publisher or collector of the content, the user needs to be responsible for the published or collected content. All disputes and losses arising from the published or collected content shall be borne by the publisher or collector of the content, who shall bear all direct or indirect (joint and several) legal responsibilities, and this product shall not bear any legal responsibility.
4.5 The content published and collected by the user on this product (including but not limited to the content in the existing products and functions of this product) is all the result of the user's personal behavior. All disputes and losses arising from any individual, company or other entity using the above content to engage in profit-making or non-profit-making activities, resulting in the infringement of others' intellectual property rights or other legitimate rights and interests, shall be borne by the individual, company or other entity, who shall bear all direct or indirect (joint and several) legal responsibilities, and this product shall not bear any legal responsibility.
4.6 When the user publishes or collects content on this product that infringes the intellectual property rights or other legitimate rights and interests of others, or when this product receives complaints or reports from the relevant right holders, this product has the right to delete the infringing content or take other restrictive measures, and reserves the right to transfer the matter to the relevant administrative authorities for handling. This product shall not bear all losses or other legal responsibilities arising therefrom.
4.7 When an individual user applies for registration, the user shall not use the name of an enterprise or brand that has been registered in the industry and commerce bureau as the username. If it is verified that the user cannot provide the relevant certificate, this product has the right to reclaim the account. The deletion or other restrictive measures taken by this product are acts of fulfilling the review and supervision obligations of the network service provider, and this product shall not bear relevant compensation responsibilities. This product, as a network service provider, has nothing to do with the disputes between the user and the relevant right holders.
5.
Limited Liability
This APP shall not be liable for any direct, indirect, accidental, special or consequential damages, which may arise from: improper use of the Network Services, online purchase of goods or similar services, online transactions, illegal use of the Network Services or changes in the information transmitted by the user. These behaviors may all lead to the damage of the image of this APP, so this APP hereby states the possibility of such damages in advance.
6.
Storage and Restriction of User Information
This APP shall not be responsible for the failure to delete or store the information published by the user. This APP has the right to determine whether the user's behavior complies with the provisions of this APP's Service Agreement. If this APP believes that the user has violated the provisions of the Service Agreement, this APP has the right to interrupt the provision of Network Services to the user.
7.
User Management
7.1 This APP only allows each user to use one account. After the user completes the registration formalities, the user obtains the right to use the account, and this right to use belongs only to the initial applicant for registration. It is prohibited to give as a gift, lend, rent, transfer or sell the account. The user shall not register maliciously, register improperly or use the account of this APP improperly. If the user has the aforementioned circumstances, this APP has the right to directly take all necessary measures, cancel all the rights and interests of the user on this APP, including but not limited to deleting the published content, suspending, sealing, freezing the account, canceling the transaction, stopping the provision of services, canceling the relevant information of the user, reclaiming the user's account, and pursuing the user's liability through litigation and other means. The user shall set the username and password of the account by himself/herself and keep them properly. The user should not transfer or lend the account and password to others for use. If the account and password are illegally used by others due to hacking or the user's negligence in keeping them, this APP shall not bear any responsibility. The user should recover the losses from the infringing party through judicial, administrative and other relief channels and bear the legal liability to the third party by himself/herself. This APP will provide necessary cooperation and assistance at the request of the administrative or judicial authorities.
7.2 The user shall legally enjoy the copyright or other relevant legal rights for the original works or the works reprinted with the authorization of the copyright owner that the user uploads to the software of this APP through the Network Services of this APP. For any content that the user uploads to the publicly accessible area of this APP through the Network Services of this APP, the user agrees that this APP has the right and permission to use, copy, modify, translate, create derivative works based on, disseminate, perform and display such content (in whole or in part) worldwide, free of charge, permanently and irrevocably.
7.3 When using the Network Services of this APP, the user must comply with the relevant national laws and regulations and bear all civil, administrative or criminal legal responsibilities caused by the improper release of information by himself/herself. When the user publishes information on this APP, the user must follow the following principles:
7.3.1 Comply with the relevant laws and regulations of China;
7.3.2 Comply with all network protocols, regulations and procedures related to the Network Services;
7.3.3 Do not use the Network Service System for any illegal purpose;
7.3.4 Do not use the Network Service System of this APP to carry out any behavior that may have an adverse impact on the normal operation of the Internet.
7.4 It is prohibited for the user to create, copy, publish or disseminate information containing the following contents on the web pages of this APP or by using the services of this APP:
7.4.1 Endangering national security, disclosing state secrets, subverting state power and undermining national unity;
7.4.2 Damaging national honor and interests and attacking the Party and the government;
7.4.3 Inciting ethnic hatred and ethnic discrimination and undermining national unity;
7.4.4 Damaging the friendly relations between countries and regions;
7.4.5 Violating the traditional Chinese virtues, social morality, ethical morality and the socialist spiritual civilization;
7.4.6 Violating national religious policies and advocating cults and feudal superstitions;
7.4.7 Spreading rumors or false information, disturbing social order and undermining social stability;
